DMCA Policy

TempShare respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), TempShare will respond expeditiously to claims of copyright infringement when a proper notice is provided to our designated agent.

Filing a DMCA Notice

If you believe that content accessible through TempShare infringes your copyright, please submit a written notice that includes all of the following elements:

  1. Physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notice, a representative list of such works is acceptable.
  3. Identification of the infringing material and the URL(s) on TempShare where it can be found, sufficient for us to locate the material.
  4. Your contact information including name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

Our Response Process

Upon receiving a valid DMCA notice, TempShare will:

  1. Review the notice for completeness and validity
  2. Disable access to the allegedly infringing content promptly
  3. Notify the uploader (if possible) that their content has been removed
  4. Provide the uploader with information about filing a counter-notification

Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification. A counter-notification must include:

  • Your physical or electronic signature
  • Identification of the removed content and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the content was removed by mistake
  • Your name, address, phone number, and a statement consenting to jurisdiction

Repeat Infringers

TempShare has a policy of terminating access for users who are repeat copyright infringers, in appropriate circumstances. We may ban IP addresses or enforce other technical measures against repeat offenders.

Misuse of DMCA Process

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability. Do not submit false DMCA notices.
